BILL ANALYSIS S.B. 1028 By: Haywood Agriculture 4-6-95 Committee Report (Unamended) BACKGROUND Sections 146.004 and 146.007, Agriculture Code, are provisions which came into effect in 1874 to regulate the sale of "horses, mules, and oxen." Since then, other provisions have been adopted regulating the sale of livestock, in particular cattle, and Sections 146.004 and 146.007 are no longer enforced. PURPOSE As proposed, S.B. 1028 repeals Sections 146.004 and 146.007, Agriculture Code, regarding the sale of certain livestock at auction. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Sections 146.004 (Sale of Animals at Auction) and 146.007 (Penalty for Selling Animal at Auction Without Statement of Ownership), Agriculture Code. SECTION 2. Emergency clause. Effective date: upon passage.
