BILL ANALYSIS S.B. 1046 By: Nelson (Pitts) 05-16-95 Committee Report (Unamended) BACKGROUND In 1979, the secretary of state was authorized to create a database for the Texas Administrative Code. The law was passed with the intent that a private publisher would develop and maintain the database. The database was given confidential status to give the selected publisher the ability to develop the database without competition. The database is no longer maintained by a publisher. PURPOSE S.B. 1046 deletes the provision that the database for the Texas Administrative Code is confidential. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2002.056(a), Government Code, to delete the provision that the database for the administrative code is confidential. SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause. SUMMARY OF COMMITTEE ACTION SB 1046 was considered by the House State Affairs Committee in a public hearing on May 9, 1995. The chair laid out SB 1046. The bill was reported favorably with the recommendation that it do pass and be printed and be sent to the Committee on Local and Consent Calendars by a record vote of 14 ayes, 0 nay, 0 PNV, 1 absent.
