BACKGROUND
Currently, Lampasas County is included only in the electric service
area of the Lower Colorado River Authority (district) while
receiving its water and wastewater services from the Brazos River
Authority.  The county would like to be included in the full
service area of the district due to economic development projects
and other activities the district provides.

PURPOSE
As proposed, S.B. 1076 authorizes the Lower Colorado River
Authority (district) to exercise all its powers within Lampasas
County; prohibits the district from providing water or wastewater
services in the portion of Lampasas County outside the Colorado
River watershed.

RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly
grant any additional rulemaking authority to a state officer,
department, agency or institution.

SECTION BY SECTION ANALYSIS
SECTION 1. Amends Chapter 7, Article 8280-107, V.T.C.S., by adding
Section 26, as follows:

     Sec.  26.  Authorizes the Lower Colorado River Authority
     (district), notwithstanding any other provision of this Act,
     to exercise all powers within Lampasas County that it may
     otherwise exercise within the 10 counties specified in Section
     1 of this Act.  Prohibits the district from providing water or
     wastewater services in the portion of Lampasas County outside
     the Colorado River watershed without the consent of the Brazos
     River Authority.
     
     SECTION 2.     Emergency clause.
           Effective date: upon passage.

SUMMARY OF COMMITTEE ACTION
S.B.1076 was considered by the committee in a formal meeting on May
17, 1995.

recommendation that it do pass and be printed and be sent to the
