BACKGROUND

In 1993, the Code of Criminal Procedure was amended to exempt the
use of trap and trace devices for caller identification services
from regulation by the Public Utility Commission.

PURPOSE

As proposed, S.B. 1158 redefines "trap and trace device" to provide
that the term does not include a caller identification service
provided by Commercial Mobile Radio Service provider licensed by
the Federal Communication Commission.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Subdivision (14), Section 1, Article 18.21, Code
of Criminal Procedure, to redefine "trap and trace device" to
provide that the term does not include a caller identification
service provided by Commercial Mobile Radio Service provider
licensed by the Federal Communication Commission.

SECTION 2. Emergency clause.
           Effective date: upon passage.

SUMMARY OF COMMITTEE ACTION

SB 1158 was considered by the committee in a public hearing on May
8, 1995.  The Chair laid out SB 1158 and explained the bill.  The
bill was reported favorably without amendment with the
recommendation that it do pass and be printed, and be sent to the
Committee on Local and Consent Calendars, by a record vote of 12
ayes, 0 nay, 1 pnv, and 2 absent.
