BILL ANALYSIS S.B. 1158 By: Sibley Economic Development 04-27-95 Committee Report (Unamended) BACKGROUND In 1993, the Code of Criminal Procedure was amended to exempt the use of trap and trace devices for caller identification services from regulation by the Public Utility Commission. PURPOSE As proposed, S.B. 1158 redefines "trap and trace device" to provide that the term does not include a caller identification service provided by Commercial Mobile Radio Service provider licensed by the Federal Communication Commission. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 14, Article 18.21, Code of Criminal Procedure, to redefine "trap and trace device" to provide that the term does not include a caller identification service provided by Commercial Mobile Radio Service provider licensed by the Federal Communication Commission. SECTION 2. Emergency clause. Effective date: upon passage.
