BILL ANALYSIS C.S.S.B. 1377 By: Wentworth Natural Resources 4-21-95 Committee Report (Substituted) BACKGROUND Currently, when land owned by the Lower Colorado River Authority (LCRA) is sold, LCRA is required to retain in each tract a 20 ft. wide strip. PURPOSE As proposed, C.S.S.B. 1377 exempts the sale of land to any person, state, or federal agency for use for park, recreational, or open space purposes from certain recreational easements retained by the Lower Colorado River Authority after sale of the land. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 18, Article 8280-107, V.T.C.S., to authorize the provision, requiring the district to retain in each tract of land sold by the district a portion for public sports and amusements, to be waived in any sales of land by the district to any person or state or federal agency for park, recreational, or open space purposes. SECTION 2. Makes application of this Act prospective. SECTION 3. Emergency clause. Effective date: upon passage.
