BILL ANALYSIS S.B. 1390 By: Rosson State Affairs 4-25-95 Committee Report (Amended) BACKGROUND Texas has an extremely successful motorcycle education program that is administered by the Texas Department of Public Safety and funded by a $5 fee on motorcycle license (Class M license) renewals. However, demand for this motorcycle safety training is growing much more quickly than revenues from license renewals. In addition, the current law dedication of the Class M license renewal fees for motorcycle education purposes will end on September 1, 1995. PURPOSE As proposed, S.B. 1390 requires the Texas Department of Public Safety to collect an additional $5 fee to be deposited in the motorcycle education fund for certain driver license transactions involving a Class M license. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 19(a), Article 6687b, V.T.C.S., to require the Texas Department of Public Safety to collect an additional $5 fee to be deposited in the motorcycle education fund for all driver license transactions under this Act or Article 6687b-2, Commercial driver's license, involving a Class M license. Provides that this fee does not apply to persons applying for a duplicate license. Makes conforming changes. SECTION 2. Repealer: Section 19(c), Article 6687b, V.T.C.S. (relating to Fees for License and Examination). SECTION 3. Amends Section 4(a), Article 6701c-4, V.T.C.S., to exempt the motorcycle education fund from Sections 403.094 and 403.095, Government Code. SECTION 4. Emergency clause. Effective date: upon passage.
