                                   Committee Report (Substituted)
BACKGROUND

In the 1980s, Austin selected a tract of land east of Manor, Texas,
as the site of a new airport, and annexed territory in the
direction of the airport that allowed the site to be included in
the extraterritorial jurisdiction (ETJ) of the city. The city has
no plans to provide service to the area until well into the 21st
century. The owners of this rural area would prefer the option of
being in the ETJ of Manor, which lies between their land and the
City of Austin.

PURPOSE

As proposed, C.S.S.B. 1397 sets forth provisions relating to the
release of extraterritorial jurisdiction (ETJ) over a tract of land
by certain municipalities and the inclusion of that tract in the
ETJ of another municipality.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.
