BACKGROUND

Each legislative session, advisory boards, commissions, and
councils are created to perform specific purposes to make
recommendations or implement state policy.  These entities often
exist in state law after the purpose of the agency has been
completed.

PURPOSE

C.S.S.B. 1428 abolishes certain inactive state agencies.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not grant any
additional rulemaking authority to a state officer, institution, or
agency.  However, all existing rulemaking authority of the Texas
Incentive and Productivity Commission is transferred to the
governor's office in SECTION 12 of the bill.

SECTION BY SECTION ANALYSIS

ARTICLE 1.     ABOLITION OF THE ADVISORY BOARD TO THE BILL
BLACKWOOD LAW ENFORCEMENT MANAGEMENT INSTITUTE OF TEXAS.  Abolishes
the Bill Blackwood Law Enforcement Management Institute of Texas
advisory board and deletes language creating the board and other
references to the board.

ARTICLE 2.     ABOLITION OF BEACH STUDY COMMITTEE.  Abolishes the
beach study committee and repeals reference to the committee.

ARTICLE 3.     ABOLITION OF TEXAS CHILDREN 2000 ORGANIZATIONAL
COMMITTEE.  Abolishes the Texas Children 2000 Organizational
Committee and repeals reference to the committee.

ARTICLE 4.     ABOLITION OF JOINT INTERIM COMMITTEE ON THE TEXAS
CULTURAL ENDOWMENT FUND.  Abolishes the joint interim committee on
the Texas Cultural Endowment Fund and repeals reference to the
fund.

ARTICLE 5. ABOLITION OF TEXAS HIGH-SPEED RAIL AUTHORITY.  Abolishes
the Texas High-Speed Rail Authority and repeals the Texas High-Speed Rail Act.  All unobligated funds of the Authority are
transferred to the general revenue fund.

ARTICLE 6.     ABOLITION OF TEXAS PARTNERSHIP FOR ECONOMIC
DEVELOPMENT.  Abolishes the Texas Partnership for Economic
Development.  Authorizes the partnership to continue to exist if
the partnership has been organized as a nonprofit corporation. 
Provides that if the partnership has not been organized as a
nonprofit corporation, any unencumbered assets are transferred to
the Texas Department of Commerce and deletes language creating and
any reference to the partnership.  Repeals reference to the
partnership.

ARTICLE 7.     ABOLITION OF EDWARDS AQUIFER LEGISLATIVE OVERSIGHT
COMMITTEE.  Abolishes the Edwards Aquifer Legislative Oversight
Committee and repeals reference to the committee.

ARTICLE 8.     ABOLITION OF EDUCATIONAL ECONOMIC POLICY CENTER. 
Abolishes the Educational Economic Policy Center and repeals
reference to the center.

ARTICLE 9.     ABOLITION OF ENVIRONMENTAL ADVISORY COMMITTEE TO THE
TEXAS DEPARTMENT OF TRANSPORTATION.  Abolishes the Environmental
Advisory Committee to the Texas Department of Transportation and
deletes language creating and any reference to the committee.

ARTICLE 10.    ABOLITION OF GATEWAY STATE PARK BOARD.  Abolishes
the Gateway State Park Board and repeals references to the board.

     SECTION 10.02.  Amends Section 22.243, Parks and Wildlife
Code, as follows:
     Sec. 22.343.  New heading: POWERS AND DUTIES OF DEPARTMENT. 
     Makes conforming changes.
     
ARTICLE 11.    ABOLITION OF TEXAS HAZARDOUS MATERIALS SAFETY
COUNCIL.  Abolishes the Texas Hazardous Materials Safety Council
and repeals reference to the council.

ARTICLE 12.    ABOLITION OF TEXAS INCENTIVE AND PRODUCTIVITY
COMMISSION.  Abolishes the Texas Incentive and Productivity
Commission and repeals reference to the commission.

     SECTION 12.02.  Amends the chapter heading of Chapter 2108,
     Health and Safety Code, as follows: 
                                                                 CHAPTER 2108. STATE EMPLOYEE INCENTIVE PROGRAM

     SECTION 12.03.  Subchapter B, Chapter 2108, Government Code,
     is amended to read as follows:

     Sec. 2108.001.  Redesignated from existing Section 2108.021. 
     Redefines "agency coordinator."
     
     Sec. 2108.002.  Redesignated from existing Section 2108.022. 
     Provides that the state employee incentive program is
     administered by the governor's office.  Sets the purposes of
     the program.  Makes a conforming change.
     
     Sec. 2108.003.  Redesignated from existing Section 2108.023. 
     Requires the governor's office to divide any bonus for a
     suggestion submitted by more than one employee among the
     employees submitting the suggestion.  Makes conforming
     changes.
     
     Sec. 2108.004-2108.007.  Redesignated from existing Sections
     2108.024-2108.027.  Makes conforming changes.
     
     Sec. 2108.008.  Redesignated from existing Section 2108.009. 
     (a)  Makes no change.
     
     (b)  Sets forth the required duties of an agency
       coordinator.
     Sec. 2108.009.  Redesignated from existing Section 2108.029. 
     Makes conforming changes.
     
     Sec. 2108.010.  New heading: PROCEDURE.  Redesignated from
     existing Section 2108.030.  Makes conforming changes.
     Sec. 2108.011.-2108.015.  Redesignated from 2108.031.-2108.035. Make conforming changes.
     
     Sec. 2108.016.  CLAIMS ASSIGNED TO STATE.  Redesignated from
     2108.036.  Makes a conforming change. 
     
     Sec. 2108.017.  Redesignated from existing Section 2108.037. 
     Makes a conforming change.  
     
     Sec. 2108.018-2108.019.  Redesignated from existing Section

           SECTION 12.04.  Repeals Subchapters A and C, Chapter 2108,
           Government Code.

     SECTION 12.05.  Repealers, conforming changes.

     SECTION 12.06.  Transfers all functions of the Texas Incentive
     and Productivity Commission to the Governor's office.

ARTICLE 13.    ABOLITION OF TEXAS INNOVATION INFORMATION NETWORK
SYSTEM.  Abolishes the Texas Innovation Information Network System
and repeals reference to the system.  Authorizes the system to
continue to exist after the effective date of this Act only for the
purposes of dissolving and of disposing of any unencumbered assets
in accordance with law.

ARTICLE 14.    ABOLITION OF TEXAS ADVISORY COMMISSION ON
INTERGOVERNMENTAL RELATIONS.  Abolishes the Texas Advisory
Commission on Intergovernmental Relations and repeals reference to
the commission.

ARTICLE 15.    ABOLITION OF SELECT COMMITTEE ON RATE AND POLICY
FORM REGULATION.  Abolishes the Select Committee on Insurance Rate
and Policy Form Regulation and repeals reference to the committee.

ARTICLE 16.    ABOLITION OF JOB TRAINING PARTNERSHIP ACT MONITORING
COMMITTEE.  Abolishes the Job Training Partnership Act Monitoring
Committee and repeals reference to the committee.

ARTICLE 17.    ABOLITION OF UNIFORM JURY HANDBOOK LEGISLATIVE
OVERSIGHT COMMITTEE.  Abolishes the Uniform Jury Handbook
Legislative Oversight Committee and repeals reference to the
committee.

ARTICLE 18.    ABOLITION OF LEGISLATIVE CRIMINAL JUSTICE BOARD. 
Abolishes the Legislative Criminal Justice Board and repeals
reference to the board.

ARTICLE 19.    ABOLITION OF LEGISLATIVE HEALTH AND HUMAN SERVICE
BOARD.  Abolishes the Legislative Health and Human Service Board
and repeals reference to the board.

ARTICLE 20.    ABOLITION OF ADVISORY AND OVERSIGHT COMMITTEE ON
MEDICAL AND HEALTH CARE PROFESSIONS MINORITY RECRUITMENT. 
Abolishes the Advisory and Oversight Committee on Medical and
Health Care Professions Minority Recruitment and repeals reference
to the committee.

ARTICLE 21.    ABOLITION OF MULTISTATE TAX COMPACT ADVISORY
COMMITTEE.  Abolishes the Multistate Tax Compact Advisory Committee
and repeals reference to the committee.

ARTICLE 22.    ABOLITION OF TEXAS PARTNERSHIP AND SCHOLARSHIP
PROGRAM ADVISORY COUNCIL.  Abolishes the Texas Partnership and
Scholarship Program Advisory Council and repeals reference to the
council.

ARTICLE 23.    ABOLITION OF POSTADOPTION SERVICES ADOPTION
COMMITTEE.  Abolishes the Postadoption Services Advisory Committee
and repeals reference to the committee.

ARTICLE 24.    ABOLITION OF STATE PRESERVATION BOARD PERMANENT
ADVISORY COMMITTEE.  Abolishes the State Preservation Board
Permanent Advisory Committee and deletes language regarding the
advisory committee.

ARTICLE 25.    ABOLITION OF PRODUCT DEVELOPMENT ADVISORY BOARD. 
Abolishes the Product Development Board and deletes language
regarding the board and repeals reference to the board.

ARTICLE 26.    ABOLITION OF ROLE OF THE FAMILY IN REDUCING
RECIDIVISM ADVISORY COMMITTEE.  Abolishes the Role of the Family in
Reducing Recidivism Advisory Commission and repeals reference to
the committee.

ARTICLE 27.    ABOLITION OF SMART JOBS FUND PROGRAM LEGISLATIVE
REVIEW COMMITTEE.  Abolishes the SMART Jobs Funds Program
Legislative Review Committee and repeals reference to the
committee.

ARTICLE 28.    Transition language.  

SECTION 28.01.  Requires the General Services Commission to take
custody of the property and records of a state governmental entity
abolished by this Act unless the governor designates another
appropriate state agency to take custody of an entity's property
and records.  

SECTION 28.02.  Effective date: September 1, 1995.

SECTION 28.03.  Emergency clause.

COMPARISON OF ORIGINAL TO SUBSTITUTE

The original abolished the Legislative Health and Human Services
Board, and the substitute does not.

The substitute abolishes the following boards, commissions and
agencies that the original does not:  The Bill Blackwood Law
Enforcement Management Institute of Texas advisory board; the Beach
Study Committee; the Texas Incentive and Productivity Commission

SUMMARY OF COMMITTEE ACTION

SB 1428 was considered by the Committee on State Affairs in a
public hearing on May 16, 1995.  The Chair laid out SB 1428 and
explained the bill.  The committee considered a complete substitute
for the bill.  The substitute was adopted without objection.  The
bill was reported favorably without amendment, with the
recommendation that it do pass and be printed, by a record vote of:
12 ayes; 0 nays; 1 pnv; and 2 absent.
