BILL ANALYSIS C.S.S.B. 1439 By: Brown (Goodman) 5-19-95 Committee Report (Substituted) BACKGROUND The arbitration statutes are currently found in Articles 224 through 238-6, V.T.C.S. Arbitration is an alternative to litigation that is becoming increasingly poular, and the arbitration statutes would be more conveniently located in the Civil Practices and Remedies Code. PURPOSE As proposed, C.S.S.B. 1439 nonsubstantively codifies the General Arbitration Statutes from Title 10, V.T.C.S., into Chapter 171, General Arbitration. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Redesignates Title 10, V.T.C.S., as General Arbitration, Chapter 171, Civil Practice and Remedies Code. Repealer: Articles 224 through 238-6, V.T.C.S. (Texas General Arbitration Act). SECTION 2. Effective date: September 1, 1995. SECTION 3. Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE The substitute is a legislative council draft which made the required technical changes. SUMMARY OF COMMITTEE ACTION S.B. 1439 was considered by the Committee on Civil Practices in a formal meeting on May 18, 1995. The committee considered a complete committee substitute, which was adopted without objection. The bill was reported favorably, as substituted, with the recommendation that it do pass and be printed, by a record vote of six ayes, zero nays, zero pnv and three absent.
