BILL ANALYSIS C.S.S.B. 1439 By: Brown Jurisprudence 4-19-95 Committee Report (Substituted) BACKGROUND The arbitration statutes are currently found in Articles 224 through 238-6, V.T.C.S. Arbitration is an alternative to litigation that is becoming increasingly poular, and the arbitration statutes would be more conveniently located in the Civil Practices and Remedies Code. PURPOSE As proposed, C.S.S.B. 1439 nonsubstantively codifies the General Arbitration Statutes from Title 10, V.T.C.S., into Chapter 156, Texas General Arbitration Act.. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Redesignates Title 10, V.T.C.S., as the Texas General Arbitration Act, Chapter 156, Civil Practice and Remedies Code. SECTION 2. Repealer: Articles 224 through 238-6, V.T.C.S. (Texas General Arbitration Act). SECTION 3. Effective date: September 1, 1995. SECTION 4. Emergency clause. Effective date: upon passage.
