BILL ANALYSIS S.B. 1525 By: Rosson State Affairs 5-8-95 Committee Report (Unamended) BACKGROUND When Franklin Mountains State Park was originally created, the Texas Parks and Wildlife Department was not supplied with a legal method by which it could acquire land in the McMath survey or mineral interests in the park. PURPOSE As proposed, S.B. 1525 requires the Texas Parks and Wildlife Department to acquire certain real property owned by the permanent school fund. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Requires the Texas Parks and Wildlife Department (department) to acquire, by purchase or exchange for fair market value, all of the real property owned by the permanent school fund located within the Franklin Mountains State Park in El Paso County, Texas, by deed from the permanent school fund. Sets forth the description of the real property owned by the permanent school fund located within Franklin Mountains State Park. SECTION 2. Provides that the intention of this Act is that all of the real property owned by the permanent school fund located within Franklin Mountains State Park be conveyed to the department in exchange for fair market value. Sets forth the determination of fair market value. Requires the acquisition to be completed no later than December 31, 1995. SECTION 3. Emergency clause. Effective date: 90 days after adjournment.
