BILL ANALYSIS S.J.R. 35 By: Ratliff Education 3-2-95 Committee Report (Unamended) BACKGROUND Currently, the Education Code does not provide a method for citizens to petition to recall a member of a board of trustees of a local school district. PURPOSE As proposed, S.J.R. 35 requires the submission to the voters of a constitutional amendment authorizing elections for the recall of school district trustees. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article VII, Texas Constitution, by adding Section 3-c, to authorize a member of the board of trustees of a school district to be removed from office by a majority vote of the qualified voters of the school district at an election held to recall the school district trustee as provided by general law. SECTION 2. Requires this proposed constitutional amendment to be submitted to the voters at an election to be held November 7, 1995. Sets forth the required language for the ballot.
