No. 46 1-2 (In the Senate - Received from the House April 6, 1995; 1-3 April 10, 1995, read first time and referred to Committee on 1-4 Economic Development; May 18, 1995, reported favorably by the 1-5 following vote: Yeas 6, Nays 0; May 18, 1995, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to consideration of certain claims in nonrenewal of 1-9 certain insurance policies. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Section 7(a), Article 21.49-2B, Insurance Code, 1-12 is amended to read as follows: 1-13 (a) This section applies only to standard fire, homeowners', 1-14 and farm or ranch owners' insurance policies. A claim under this 1-15 section does not include: 1-16 (1) a claim resulting from a loss caused by natural 1-17 causes; or 1-18 (2) a claim that is filed but is not paid or payable 1-19 under the policy. 1-20 SECTION 2. This Act takes effect September 1, 1995, and 1-21 applies only to a claim filed with the insurer on or after that 1-22 date. A claim filed before September 1, 1995, is governed by the 1-23 law as it existed before the effective date of this Act, and that 1-24 law is continued in effect for that purpose. 1-25 SECTION 3. The importance of this legislation and the 1-26 crowded condition of the calendars in both houses create an 1-27 emergency and an imperative public necessity that the 1-28 constitutional rule requiring bills to be read on three several 1-29 days in each house be suspended, and this rule is hereby suspended. 1-30 * * * * *
