A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to enforcement of a writ of habeas corpus issued by
1-3 another state regarding the possession of a child.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter B, Chapter 11, Family Code, is amended
1-6 by adding Section 11.631 to read as follows:
1-7 Sec. 11.631. RECOGNITION OF OUT-OF-STATE WRIT OF HABEAS
1-8 CORPUS. The courts of this state shall recognize and enforce a
1-9 writ of habeas corpus relating to possession of a child that was:
1-10 (1) issued by a court of another state that had
1-11 assumed jurisdiction under statutory provisions substantially in
1-12 accordance with this subchapter; or
1-13 (2) issued under factual circumstances meeting the
1-14 jurisdictional standards of this subchapter.
1-15 SECTION 2. This Act takes effect September 1, 1995.
1-16 SECTION 3. The importance of this legislation and the
1-17 crowded condition of the calendars in both houses create an
1-18 emergency and an imperative public necessity that the
1-19 constitutional rule requiring bills to be read on three several
1-20 days in each house be suspended, and this rule is hereby suspended.
