                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the renewal of certain alcoholic beverage permits and
    1-3  licenses by the operator of a sexually oriented business.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 11.43(c), Alcoholic Beverage Code, is
    1-6  amended to read as follows:
    1-7        (c)  A hearing shall be held on any renewal application of a
    1-8  mixed beverage permit, private club registration permit, wine and
    1-9  beer retailer's permit, or retail dealer's on-premise license if a
   1-10  sexually oriented business is to be operated on the premises to be
   1-11  covered by the permit or license and a petition is presented to the
   1-12  commission requesting a hearing which is signed by 50 percent of
   1-13  the residents who reside within 300 feet of any property line of
   1-14  the affected premises.  An applicant for a renewal permit or
   1-15  license shall give written notice that a renewal application has
   1-16  been filed to each head of household who resides within 300 feet of
   1-17  any property line of the affected premises not more than 45 days
   1-18  before and not less than 30 days before the expiration date of a
   1-19  permit or license.
   1-20        SECTION 2.  This Act takes effect September 1, 1995.  The
   1-21  change in law made by this Act applies only to persons who apply
   1-22  for a renewal permit or license on or after the effective date of
   1-23  this Act.
   1-24        SECTION 3.  The importance of this legislation and the
    2-1  crowded condition of the calendars in both houses create an
    2-2  emergency and an imperative public necessity that the
    2-3  constitutional rule requiring bills to be read on three several
    2-4  days in each house be suspended, and this rule is hereby suspended.
