A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the local regulation of sound coming from premises
1-3 covered by certain alcoholic beverage permits or licenses.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 101.62, Alcoholic Beverage Code, is
1-6 amended to read as follows:
1-7 Sec. 101.62. OFFENSIVE NOISE ON PREMISES. (a) No licensee
1-8 or permittee, on premises under his control, may maintain or permit
1-9 a radio, television, amplifier, piano, phonograph, music machine,
1-10 orchestra, band, singer, speaker, entertainer, or other device or
1-11 person that produces, amplifies, or projects music or other sound
1-12 that is loud, vociferous, vulgar, indecent, lewd, or otherwise
1-13 offensive to persons on or near the licensed premises.
1-14 (b) The commissioners court of a county may enact
1-15 regulations applicable in areas in the county outside a
1-16 municipality, and the governing body of a municipality may enact
1-17 regulations applicable in the municipality, regulating the amount
1-18 of sound coming from a premises covered by a:
1-19 (1) private club registration permit; or
1-20 (2) permit or license that authorizes the sale of
1-21 alcoholic beverages for on-premise consumption.
1-22 SECTION 2. This Act takes effect September 1, 1995.
1-23 SECTION 3. The importance of this legislation and the
1-24 crowded condition of the calendars in both houses create an
2-1 emergency and an imperative public necessity that the
2-2 constitutional rule requiring bills to be read on three several
2-3 days in each house be suspended, and this rule is hereby suspended.
