    1-7  COMMITTEE AMENDMENT NO. 1                             By:  Galloway
    1-8  Amend H.B. 160 as follows:
    1-9        On page 1, line 9, insert the following after the period:
   1-10  "The commissioner's court may not adopt regulations under this
   1-11  section concerning the disposal of recyclable materials as defined
   1-12  in Section 361 of the Health and Safety Code."
   1-13                         A BILL TO BE ENTITLED
   1-14                                AN ACT
   1-15  relating to the regulation of litter by counties.
   1-16        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
   1-17        SECTION 1.  Section 365.017(a), Health and Safety Code, is
   1-18  amended to read as follows:
   1-19        (a)  The commissioners court of a county <with a population
   1-20  of one million or more> may adopt regulations to control the
   1-21  disposal of litter and the removal of illegally dumped litter from
   1-22  private property in unincorporated areas of that county.
   1-23        SECTION 2.  The importance of this legislation and the
   1-24  crowded condition of the calendars in both houses create an
   1-25  emergency and an imperative public necessity that the
   1-26  constitutional rule requiring bills to be read on three several
   1-27  days in each house be suspended, and this rule is hereby suspended,
   1-28  and that this Act take effect and be in force from and after its
   1-29  passage, and it is so enacted.
