No. 231 74R2090 MI-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the election and terms of office of the board of 1-3 directors of the Tarrant County Water Control and Improvement 1-4 District No. 1. 1-5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-6 SECTION 1. Chapter 268, Acts of the 55th Legislature, 1-7 Regular Session, 1957 (Article 8280-207, Vernon's Texas Civil 1-8 Statutes), is amended by adding Sections 1a and 2a to read as 1-9 follows: 1-10 Sec. 1a. (a) The district is governed by a board of seven 1-11 directors elected as prescribed by Chapter 55, Water Code, except 1-12 that the board in office preceding the date of the initial election 1-13 under this section shall establish seven precincts from which the 1-14 directors are elected. 1-15 (b) Directors shall serve staggered four-year terms. 1-16 (c) One director shall be elected from each precinct. 1-17 (d) A person shall indicate on the application for a place 1-18 on the ballot the precinct that the person seeks to represent. 1-19 (e) The board shall revise each precinct after each federal 1-20 decennial census to reflect population changes. At the first 1-21 election after the precincts are revised, a new director shall be 1-22 elected from each precinct. The directors shall draw lots to 1-23 determine which three directors shall serve two-year terms and 1-24 which four directors shall serve four-year terms. 2-1 Sec. 2a. (a) The first election under Section 1a of this 2-2 Act shall be held on August 19, 1995. 2-3 (b) The initial elected directors shall draw lots to 2-4 determine which three directors shall serve two-year terms and 2-5 which four directors shall serve four-year terms. 2-6 (c) After the initial election of directors, an election 2-7 shall be held on the first Saturday in May of each odd-numbered 2-8 year, and the appropriate number of successor directors shall be 2-9 elected to serve four-year terms. 2-10 (d) The terms of the directors serving on the date of the 2-11 first election under Section 1a of this Act expire when the 2-12 initially elected directors take office. 2-13 SECTION 2. Notwithstanding Section 1a(a), Chapter 268, Acts 2-14 of the 55th Legislature, 1957 (Article 8280-207, Vernon's Texas 2-15 Civil Statutes), as added by this Act, the board of the Tarrant 2-16 County Water Control and Improvement District No. 1 consists of 2-17 five members until the sixth and seventh members elected under 2-18 Section 2a(a) of that Act qualify for office. 2-19 SECTION 3. The importance of this legislation and the 2-20 crowded condition of the calendars in both houses create an 2-21 emergency and an imperative public necessity that the 2-22 constitutional rule requiring bills to be read on three several 2-23 days in each house be suspended, and this rule is hereby suspended, 2-24 and that this Act take effect and be in force from and after its 2-25 passage, and it is so enacted.
