                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to access to a student's educational records.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 552.114, Government Code, is amended by
    1-5  adding Subsections (c) and (d) to read as follows:
    1-6        (c)  To the extent of a conflict between the access granted
    1-7  by Subsection (b) to a student record and the exception established
    1-8  by Section 552.111, Subsection (b) prevails.
    1-9        (d)  In this section, "student record" includes all
   1-10  information regarding the student and the student's relationship to
   1-11  the institution, including applications for admission, test scores,
   1-12  attendance information, health information, teacher or counselor
   1-13  ratings and observations, reports of behavioral patterns or
   1-14  disciplinary actions, and notes, correspondence, or reports
   1-15  prepared in connection with the institution's investigation of the
   1-16  student's conduct or disciplinary action against the student.
   1-17        SECTION 2.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended,
   1-22  and that this Act take effect and be in force from and after its
   1-23  passage, and it is so enacted.
