No. 347 1-2 (In the Senate - Received from the House April 21, 1995; 1-3 April 24, 1995, read first time and referred to Committee on 1-4 Economic Development; May 16, 1995, reported favorably by the 1-5 following vote: Yeas 9, Nays 0; May 16, 1995, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to insurance coverage for certain real property 1-9 foundations. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Article 5.35-2, Insurance Code, is repealed. 1-12 SECTION 2. (a) An endorsement that was authorized under 1-13 Article 5.35-2, Insurance Code, as that article existed prior to 1-14 repeal by this Act, may not be used on any policy delivered, issued 1-15 for delivery, or renewed on or after the effective date of this 1-16 Act. 1-17 (b) The repeal of Article 5.35-2, Insurance Code, by this 1-18 Act does not otherwise affect the authority of the commissioner of 1-19 insurance under other provisions of the Insurance Code to 1-20 promulgate policy and endorsement provisions regarding the 1-21 foundation or slab of an insured dwelling. 1-22 SECTION 3. The importance of this legislation and the 1-23 crowded condition of the calendars in both houses create an 1-24 emergency and an imperative public necessity that the 1-25 constitutional rule requiring bills to be read on three several 1-26 days in each house be suspended, and this rule is hereby suspended, 1-27 and that this Act take effect and be in force from and after its 1-28 passage, and it is so enacted. 1-29 * * * * *
