No. 375 1-2 (In the Senate - Received from the House May 10, 1995; 1-3 May 11, 1995, read first time and referred to Committee on 1-4 Intergovernmental Relations; May 19, 1995, reported favorably by 1-5 the following vote: Yeas 8, Nays 0; May 19, 1995, sent to 1-6 printer.) 1-7 A BILL TO BE ENTITLED 1-8 AN ACT 1-9 relating to billing for an assessment by certain municipalities for 1-10 expenses incurred in relation to certain neglected property. 1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-12 SECTION 1. Section 342.007, Health and Safety Code, is 1-13 amended by adding Subsection (h) to read as follows: 1-14 (h) A bill for an amount assessed under this section may be 1-15 included on or with a bill for property taxes on the assessed 1-16 property. The inclusion of or failure to include a bill for the 1-17 amount assessed with a bill for property taxes does not alter or 1-18 affect the priority or date of attachment of the lien, if any, for 1-19 the amount assessed. 1-20 SECTION 2. Subchapter A, Chapter 214, Local Government Code, 1-21 is amended by adding Section 214.004 to read as follows: 1-22 Sec. 214.004. BILL FOR ASSESSMENT. A bill for an amount 1-23 assessed under this subchapter may be included on or with a bill 1-24 for property taxes on the assessed property. The inclusion of or 1-25 failure to include a bill for the amount assessed with a bill for 1-26 property taxes does not alter or affect the priority or date of 1-27 attachment of the lien, if any, for the amount assessed. 1-28 SECTION 3. The importance of this legislation and the 1-29 crowded condition of the calendars in both houses create an 1-30 emergency and an imperative public necessity that the 1-31 constitutional rule requiring bills to be read on three several 1-32 days in each house be suspended, and this rule is hereby suspended, 1-33 and that this Act take effect and be in force from and after its 1-34 passage, and it is so enacted. 1-35 * * * * *
