                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to a prohibition on the listing of a county clerk's name
    1-3  on election supplies at an election in which the clerk is a
    1-4  candidate.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Subchapter A, Chapter 51, Election Code, is
    1-7  amended by adding Section 51.014 to read as follows:
    1-8        Sec. 51.014.  PROHIBITION ON COUNTY CLERK'S NAME APPEARING ON
    1-9  ELECTION SUPPLIES.  (a)  The name of the person holding the office
   1-10  of county clerk may not appear on election supplies for an election
   1-11  at which that person is a candidate for office.
   1-12        (b)  The prohibition prescribed by Subsection (a) applies
   1-13  only to the appearance of the name in connection with the person's
   1-14  status as the incumbent and does not apply in connection with the
   1-15  person's status as a candidate or voter.
   1-16        SECTION 2.  This Act takes effect September 1, 1995.
   1-17        SECTION 3.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended.
