                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the method of filling a vacancy on the State Board of
    1-3  Education.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 11.22(i), Education Code, is amended to
    1-6  read as follows:
    1-7        (i)  In case of resignation or death of a board member, or in
    1-8  case a position on the board otherwise becomes vacant, the
    1-9  unexpired term shall be filled by special election in the same
   1-10  manner as provided by Chapter 203, Election Code, for the
   1-11  legislature, except that Section 203.013, Election Code, does not
   1-12  apply.  The governor shall order an election to be held under this
   1-13  subsection <board shall fill such vacancy as soon as possible by
   1-14  appointment of a qualified person from the affected district.  The
   1-15  appointee shall hold office only until his successor is duly
   1-16  elected for the remainder of the unexpired term at the next general
   1-17  election and has qualified by taking the required oath and filing
   1-18  the required bond or until expiration of the term of office to
   1-19  which he has been appointed, whichever occurs first>.
   1-20        SECTION 2.  Sections 11.22(j) and (m), Education Code, are
   1-21  repealed.
   1-22        SECTION 3.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended.
