                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to allowing a governmental entity to regulate certain
    1-3  establishments required to have an alcoholic beverage license or
    1-4  permit.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Section 109.57(d), Alcoholic Beverage Code, is
    1-7  amended to read as follows:
    1-8        (d)  This section does not affect the authority of a
    1-9  governmental entity to regulate, in a manner as otherwise permitted
   1-10  by law, the location of:
   1-11              (1)  a massage parlor, nude modeling studio, or other
   1-12  sexually oriented business; or
   1-13              (2)  an establishment that derives 75 percent or more
   1-14  of the establishment's gross revenue from the <on-premise> sale of
   1-15  alcoholic beverages for consumption on or off the establishment's
   1-16  premises.
   1-17        SECTION 2.  The importance of this legislation and the
   1-18  crowded condition of the calendars in both houses create an
   1-19  emergency and an imperative public necessity that the
   1-20  constitutional rule requiring bills to be read on three several
   1-21  days in each house be suspended, and this rule is hereby suspended,
   1-22  and that this Act take effect and be in force from and after its
   1-23  passage, and it is so enacted.
