A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the composition and functions of the Commission on Fire
1-3 Protection.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 419.023(c), Government Code, is amended
1-6 to read as follows:
1-7 (c) The committee periodically shall review commission rules
1-8 relating to fire protection personnel and fire departments and
1-9 recommend changes in the rules to the commission. Notwithstanding
1-10 Section 5(f), Administrative Procedure and Texas Register Act
1-11 (Article 6252-13a, Vernon's Texas Civil Statutes), the commission
1-12 shall submit all proposed changes and additions to the rules that
1-13 relate to fire protection personnel and fire departments to the
1-14 committee for development. During the first meeting at which the
1-15 commission considers any committee recommendations, the commission
1-16 may adopt, reject, or take no action on the recommendations of the
1-17 committee. At any subsequent meeting, the commission may adopt,
1-18 modify, or reject the recommendations made by the committee. <If
1-19 the commission does not approve a rule developed by the committee,
1-20 the commission shall indicate to the committee the reasons that the
1-21 commission did not approve the rule and return the rule to the
1-22 committee for further development.>
1-23 SECTION 2. Section 419.072(c), Government Code, is amended
1-24 to read as follows:
2-1 (c) The committee shall develop and recommend to the
2-2 commission for approval the rules of the program under this
2-3 subchapter. The committee periodically shall review commission
2-4 rules relating to the commission's program under this subchapter
2-5 and recommend changes in the rules to the commission.
2-6 Notwithstanding Section 5(f), Administrative Procedure and Texas
2-7 Register Act (Article 6252-13a, Vernon's Texas Civil Statutes), the
2-8 commission shall submit all proposed rules and all proposed changes
2-9 and additions to the rules that relate to the program under this
2-10 subchapter to the committee for development. During the first
2-11 meeting at which the commission considers any committee
2-12 recommendations, the commission may adopt, reject, or take no
2-13 action on the recommendations of the committee. At any subsequent
2-14 meeting, the commission may adopt, modify, or reject the
2-15 recommendations made by the committee. <If the commission does not
2-16 approve a rule developed by the committee, the commission shall

2-18 approve the rule and return the rule to the committee for further
2-19 development.>
2-20 SECTION 3. Section 417.0041(b), Government Code, is amended
2-21 to read as follows:
2-22 (b) Each council periodically shall review commission rules
2-23 implementing the article under which the council was established
2-24 and recommend changes in the rules to the commission.
2-25 Notwithstanding Section 5(f), Administrative Procedure and Texas
2-26 Register Act (Article 6252-13a, Vernon's Texas Civil Statutes), the
2-27 commission shall submit all changes and additions to rules that
3-1 implement the article under which an advisory council was
3-2 established to that council for development. During the first
3-3 meeting at which the commission considers any committee
3-4 recommendations, the commission may adopt, reject, or take no
3-5 action on the recommendations of the committee. At any subsequent
3-6 meeting, the commission may adopt, modify, or reject the
3-7 recommendations made by the committee. <If the commission does not
3-8 approve a rule developed by the council, the commission shall
3-9 indicate to the council the reasons that the commission did not
3-10 approve the rule and return the rule to the council for further
3-11 development.>
3-12 SECTION 4. The importance of this legislation and the
3-13 crowded condition of the calendars in both houses create an
3-14 emergency and an imperative public necessity that the
3-15 constitutional rule requiring bills to be read on three several
3-16 days in each house be suspended, and this rule is hereby suspended.
