                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the capacity of a container of beer.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 1.04(18), Alcoholic Beverage Code, is
    1-5  amended to read as follows:
    1-6              (18)  "Original package," as applied to beer, means a
    1-7  container holding 50 liters, one barrel, one-half barrel,
    1-8  one-quarter barrel, or one-eighth barrel of beer in bulk, or any
    1-9  box, crate, carton, or other device used in packing beer that is
   1-10  contained in bottles or other containers.
   1-11        SECTION 2.  Section 101.44, Alcoholic Beverage Code, is
   1-12  amended to read as follows:
   1-13        Sec. 101.44.  CONTAINERS OF BEER:  CAPACITIES.  No person may
   1-14  possess, sell, or transport any beer except in containers having a
   1-15  capacity of 50 liters, one barrel, one-half barrel, one-quarter
   1-16  barrel, or one-eighth barrel, or in bottles or cans having a
   1-17  capacity of 32, 24, 16, 12, 8, or 7 fluid ounces.
   1-18        SECTION 3.  This Act takes effect September 1, 1995.
   1-19        SECTION 4.  The importance of this legislation and the
   1-20  crowded condition of the calendars in both houses create an
   1-21  emergency and an imperative public necessity that the
   1-22  constitutional rule requiring bills to be read on three several
   1-23  days in each house be suspended, and this rule is hereby suspended.
