                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to employee misconduct under the unemployment compensation
    1-3  system.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 201.012(a), Labor Code, is amended to
    1-6  read as follows:
    1-7        (a)  "Misconduct" means mismanagement of a position of
    1-8  employment by action or inaction, neglect that jeopardizes the life
    1-9  or property of another, intentional wrongdoing or malfeasance,
   1-10  intentional violation of a law, or violation of a policy or rule
   1-11  adopted to ensure the orderly work and the safety of employees.
   1-12  The term includes the inability of an employee, based on objective
   1-13  standards, to complete the work assigned by the employer or fulfill
   1-14  the responsibilities required by the position of employment.
   1-15        SECTION 2.  This Act takes effect September 1, 1995, and
   1-16  applies only to a claim for unemployment compensation benefits that
   1-17  is filed with the Texas Employment Commission on or after that
   1-18  date.  A claim filed before that date is governed by the law in
   1-19  effect on the date that the claim is filed, and the former law is
   1-20  continued in effect for that purpose.
   1-21        SECTION 3.  The importance of this legislation and the
   1-22  crowded condition of the calendars in both houses create an
   1-23  emergency and an imperative public necessity that the
   1-24  constitutional rule requiring bills to be read on three several
    2-1  days in each house be suspended, and this rule is hereby suspended.
