6-5 (b) The state or a political subdivision of the state is not
6-6 required to fill a position having duties related to animal control

6-11 Sec. 829.011. ENFORCEMENT OF ANIMAL CONTROL ORDINANCES AND
6-12 ORDERS. (a) A person who holds a certificate of registration
6-13 under this chapter and is employed as an animal control officer or

6-16 subdivision's ordinances or orders relating to animal control.
6-17 (b) The governing body of a county or municipality may
6-18 impose and collect a surcharge of not more than $4 on each penalty
6-19 imposed for violation of an ordinance or order of the political
6-20 subdivision relating to animal control or animal cruelty. The
6-21 surcharges collected may be used only to pay for continuing
6-22 education programs required by the department under this chapter
6-23 for renewal of registration as an animal control officer.
6-24 Sec. 829.012. CRIMINAL PENALTY. (a) A person who is not
6-25 exempt from this chapter under Section 829.010(a) commits an
6-26 offense if the person claims to be an animal control officer or
6-27 uses a title containing the words "animal control officer" and the
7-1 person does not hold a certificate of registration under this
    7-2 chapter.
7-3 (b) An offense under this section is a Class C misdemeanor.
7-4 SECTION 2. The Texas Department of Health shall issue a
7-5 certificate of registration as an animal control officer without
7-6 requiring the successful completion of the examination required by
7-7 Section 829.005(a), Health and Safety Code, as added by this Act,
    7-8 to a person who:
7-9 (1) applies to the department for a certificate of
   7-10  registration before March 1, 1996;
7-11 (2) pays any required fees; and
7-12 (3) submits evidence satisfactory to the department
   7-13 that the person:
7-14 (A) has been a resident of the state for at
   7-15  least one year before the date of application;
7-16 (B) has been employed in the field of animal
7-17 control for at least three years; and
7-18 (C) has complied with all applicable rules of
7-19 the Texas Board of Health.
7-20 SECTION 3. This Act takes effect September 1, 1995, except
7-21 that Section 829.002 and Section 829.012, Health and Safety Code,
7-22 as added by this Act, take effect March 1, 1996.
7-23 SECTION 4. The importance of this legislation and the
7-24 crowded condition of the calendars in both houses create an
7-25 emergency and an imperative public necessity that the
7-26 constitutional rule requiring bills to be read on three several
7-27 days in each house be suspended, and this rule is hereby suspended.
