No. 690 A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to notices required to be posted by certain applicants for 1-3 an on-premises alcoholic beverage permit or license. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Section 11.391, Alcoholic Beverage Code, is 1-6 amended by adding Subsection (d) to read as follows: 1-7 (d) An applicant for a permit issued under Chapter 25, 28, 1-8 or 32 shall comply with this section not later than the 10th day 1-9 before the date the applicant submits the application for a permit 1-10 if: 1-11 (1) the applicant's permit was canceled or suspended 1-12 during the 13-month period preceding the date of the application; 1-13 or 1-14 (2) the premises described in the application was, in 1-15 the five-year period preceding the date of the application, the 1-16 premises of another holder of an alcoholic beverage permit or 1-17 license that had been suspended or canceled. 1-18 SECTION 2. Section 61.381, Alcoholic Beverage Code, is 1-19 amended by adding Subsection (d) to read as follows: 1-20 (d) An applicant for a license issued under Chapter 69 or 74 1-21 shall comply with this section not later than the 10th day before 1-22 the date the applicant submits the application for a license if: 1-23 (1) the applicant's license was canceled or suspended 1-24 during the 13-month period preceding the date of the application; 2-1 or 2-2 (2) the premises described in the application was, in 2-3 the five-year period preceding the date of the application, the 2-4 premises of another holder of an alcoholic beverage permit or 2-5 license that had been suspended or canceled. 2-6 SECTION 3. An applicant for the renewal of an alcoholic 2-7 beverage permit or license issued under Chapter 25, 28, 32, 69, or 2-8 74, Alcoholic Beverage Code, who submits the application on or 2-9 before September 1, 1996, must comply with the law as changed by 2-10 this Act in the same manner in which an applicant for an initial 2-11 permit or license must comply. This section expires September 2, 2-12 1996. 2-13 SECTION 4. This Act takes effect September 1, 1995, and 2-14 applies only to an application for an alcoholic beverage permit or 2-15 license or renewal of an alcoholic beverage permit or license 2-16 submitted on or after the effective date of this Act. An 2-17 application for an alcoholic beverage permit or license or renewal 2-18 submitted before September 1, 1995, is governed by the law as it 2-19 existed immediately before the effective date of this Act, and that 2-20 law is continued in effect for that purpose. 2-21 SECTION 5. The importance of this legislation and the 2-22 crowded condition of the calendars in both houses create an 2-23 emergency and an imperative public necessity that the 2-24 constitutional rule requiring bills to be read on three several 2-25 days in each house be suspended, and this rule is hereby suspended.
