                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to notices required to be posted by certain applicants for
    1-3  an on-premises alcoholic beverage permit or license.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 11.391, Alcoholic Beverage Code, is
    1-6  amended by adding Subsection (d) to read as follows:
    1-7        (d)  An applicant for a permit issued under Chapter 25, 28,
    1-8  or  32 or a renewal of a permit issued under those chapters shall
    1-9  comply with this section not later than the 10th day before the
   1-10  date the applicant submits the application for a permit or renewal
   1-11  if:
   1-12              (1)  the applicant's permit was canceled or suspended
   1-13  during the 13-month period preceding the date of the application or
   1-14  the expiration of the current permit, whichever period is longer;
   1-15  or
   1-16              (2)  the premises described in the application was, in
   1-17  the five-year period preceding the date of the application, the
   1-18  premises of another holder of an alcoholic beverage permit or
   1-19  license that had been suspended or canceled.
   1-20        SECTION 2.  Section 61.381, Alcoholic Beverage Code, is
   1-21  amended by adding Subsection (d) to read as follows:
   1-22        (d)  An applicant for a license issued under Chapter 69 or 74
   1-23  or a renewal of a license issued under those chapters shall comply
   1-24  with this section not later than the 10th day before the date the
    2-1  applicant submits the application for a license or renewal if:
    2-2              (1)  the applicant's license was canceled or suspended
    2-3  during the 13-month period preceding the date of the application or
    2-4  the expiration of the current license, whichever period is longer;
    2-5  or
    2-6              (2)  the premises described in the application was, in
    2-7  the five-year period preceding the date of the application, the
    2-8  premises of another holder of an alcoholic beverage permit or
    2-9  license that had been suspended or canceled.
   2-10        SECTION 3.  This Act takes effect September 1, 1995, and
   2-11  applies only to an application for an alcoholic beverage permit or
   2-12  license or renewal of an alcoholic beverage permit or license
   2-13  submitted on or after the effective date of this Act.  An
   2-14  application for an alcoholic beverage permit or license or renewal
   2-15  submitted before September 1, 1995, is governed by the law as it
   2-16  existed immediately before the effective date of this Act, and that
   2-17  law is continued in effect for that purpose.
   2-18        SECTION 4.  The importance of this legislation and the
   2-19  crowded condition of the calendars in both houses create an
   2-20  emergency and an imperative public necessity that the
   2-21  constitutional rule requiring bills to be read on three several
   2-22  days in each house be suspended, and this rule is hereby suspended.
