                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to access to diaper changing stations in restrooms.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Subchapter D, Chapter 341, Health and Safety
    1-5  Code, is amended by adding Section 341.069 to read as follows:
    1-6        Sec. 341.069.  DIAPER CHANGING STATIONS IN RESTROOMS.  (a)  A
    1-7  facility that provides a diaper changing station in a restroom
    1-8  designated for one gender shall also provide a diaper changing
    1-9  station in the restroom designated for the other gender.
   1-10        (b)  In this section:
   1-11              (1)  "Facility" means a building used by the public or
   1-12  that serves as a workplace, and includes:
   1-13                    (A)  a building used for state or local
   1-14  governmental purposes;
   1-15                    (B)  a retail store, office, or other commercial
   1-16  establishment;
   1-17                    (C)  a grocery store;
   1-18                    (D)  a restaurant or cafeteria;
   1-19                    (E)  a school;
   1-20                    (F)  an institution of higher education;
   1-21                    (G)  a health care facility;
   1-22                    (H)  a theater, movie house, auditorium, or
   1-23  arena;
   1-24                    (I)  a library;
    2-1                    (J)  a recreational facility; or
    2-2                    (K)  a place of employment.
    2-3              (2)  "Restroom" means toilet, chemical toilet, or water
    2-4  closet.
    2-5        SECTION 2.  This Act takes effect September 1, 1995, and
    2-6  applies to a facility on which construction is started on or after
    2-7  that date.
    2-8        SECTION 3.  The importance of this legislation and the
    2-9  crowded condition of the calendars in both houses create an
   2-10  emergency and an imperative public necessity that the
   2-11  constitutional rule requiring bills to be read on three several
   2-12  days in each house be suspended, and this rule is hereby suspended.
