A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the procedures for awarding construction contracts by
1-3 or for the Parks and Wildlife Department.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 5.13(a), State Purchasing and General
1-6 Services Act (Article 601b, Vernon's Texas Civil Statutes), is
1-7 amended to read as follows:
1-8 (a) Except as otherwise provided by this article, this
1-9 article shall apply to all building construction projects as herein
1-10 defined which may be undertaken by the state, with the following
1-11 exceptions:
1-12 (1) all projects constructed by and for the State
1-13 Department of Highways and Public Transportation;
1-14 (2) all projects constructed by and for state
1-15 institutions of higher education;
1-16 (3) pens, sheds, and ancillary buildings constructed
1-17 by and for the Texas Department of Agriculture for the processing
1-18 of livestock prior to export;
1-19 (4) all projects of repair and rehabilitation, except
1-20 major renovations, of buildings and grounds on the commission
1-21 inventory;
1-22 <(5) all projects constructed by the Parks and
1-23 Wildlife Department;> and
1-24 (5) <(6)> repair and rehabilitation projects of any
2-1 other using agency, provided all labor for such projects is
2-2 provided by the regular maintenance forces of the using agency
2-3 under specific legislative authorization, and provided further,
2-4 that such projects do not require the advance preparation of
2-5 working plans and/or drawings.
2-6 SECTION 2. Subchapter B, Chapter 11, Parks and Wildlife
2-7 Code, is amended by adding Section 11.030 to read as follows:
2-8 Sec. 11.030. CONSTRUCTION PROJECTS. (a) Notwithstanding
2-9 other law, all projects, including a marina, constructed by or for
2-10 the department are subject to the provisions of Article 5, State
2-11 Purchasing and General Services Act (Article 601b, Vernon's Texas
2-12 Civil Statutes).
2-13 (b) In this section, "project" has the meaning assigned by
2-14 Section 5.12, State Purchasing and General Services Act (Article
2-15 601b, Vernon's Texas Civil Statutes).
2-16 SECTION 3. The change in law made by this Act applies only
2-17 to a construction project by or for the Parks and Wildlife
2-18 Department for which working plans and specifications are completed
2-19 on or after the effective date of this Act.
2-20 SECTION 4. This Act takes effect September 1, 1995.
2-21 SECTION 5. The importance of this legislation and the
2-22 crowded condition of the calendars in both houses create an
2-23 emergency and an imperative public necessity that the
2-24 constitutional rule requiring bills to be read on three several
2-25 days in each house be suspended, and this rule is hereby suspended.
