                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the determination of value in condemnation proceedings.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 21.042, Property Code, is amended by
    1-5  adding Subsections (f) and (g) to read as follows:
    1-6        (f)  Local market value is determined as if a tract or parcel
    1-7  of real property will not be condemned if the condemnor publicly
    1-8  proposed to condemn the property and the announcement of the
    1-9  proposed condemnation decreases the local market value.
   1-10        (g)  A condemnor that publicly proposes to condemn a tract or
   1-11  parcel of real property and unreasonably delays the beginning of a
   1-12  condemnation proceeding under this chapter is liable to the
   1-13  property owner for damages suffered during the period of
   1-14  unreasonable delay in addition to other damages authorized by this
   1-15  chapter.
   1-16        SECTION 2.  The change in law made by this Act applies only
   1-17  to a condemnation proceeding filed on or after the effective date
   1-18  of this Act.  A condemnation proceeding pending before the
   1-19  effective date of this Act is covered by the law in effect when the
   1-20  suit was filed, and the former law is continued in effect for that
   1-21  purpose.
   1-22        SECTION 3.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended.
