                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to certain acts of family violence for which a protective
    1-3  order may be issued.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 71.01(b)(2), Family Code, is amended to
    1-6  read as follows:
    1-7              (2)  "Family violence" means:
    1-8                    (A)  an act by a member of a family or household
    1-9  against another member of the family or household that is intended
   1-10  to result in physical harm, bodily injury, <or> assault, or sexual
   1-11  assault or that is a threat that reasonably places the member in
   1-12  fear of imminent physical harm, bodily injury, <or> assault, or
   1-13  sexual assault, excluding the reasonable discipline of a child by a
   1-14  person having that duty; or
   1-15                    (B)  abuse, as that term is defined by Sections
   1-16  34.012(1)(C), (E), and (G) of this code, by a member of a family or
   1-17  household toward a child of the family or household.
   1-18        SECTION 2.  This Act takes effect September 1, 1995, and
   1-19  applies only to an application for a protective order made on or
   1-20  after that date.  An application for a protective order made before
   1-21  that date is governed by the law in effect at the time the
   1-22  application was made, and the former law is continued in effect for
   1-23  that purpose.
   1-24        SECTION 3.  The importance of this legislation and the
    2-1  crowded condition of the calendars in both houses create an
    2-2  emergency and an imperative public necessity that the
    2-3  constitutional rule requiring bills to be read on three several
    2-4  days in each house be suspended, and this rule is hereby suspended.
