No. 840 1-2 (In the Senate - Received from the House March 15, 1995; 1-3 March 16, 1995, read first time and referred to Committee on State 1-4 Affairs; April 21, 1995, reported favorably, as amended, by the 1-5 following vote: Yeas 10, Nays 1; April 21, 1995, sent to printer.) 1-6 COMMITTEE AMENDMENT NO. 1 By: Nixon 1-7 Amend H.B. 840 as follows: 1-8 (1) In SECTION 1, Section 144, subsection (f), insert the 1-9 following language between the words "amounts" and "under": 1-10 "of 20 percent or more" 1-11 (2) In SECTION 1, Section 144, Subsection (f), delete the 1-12 words "state treasurer" and substitute the words "state 1-13 comptroller". 1-14 (3) In SECTION 1, Section 144, Subsection (g), delete the 1-15 word "treasurer" and substitute the word "comptroller". 1-16 (4) Add a new SECTION 2 to read as follows: 1-17 "SECTION 2. Section 144, Uniform Act Regulating Traffic on 1-18 Highways (Article 6701d, Vernon's Texas Civil Statutes), is amended 1-19 by adding Subsection (h) to read as follows: 1-20 "(h) If the state comptroller conducts an audit pursuant to 1-21 subsection (g) and it is determined that the city is retaining more 1-22 than 20% of the amounts under subsection (b) and has not complied 1-23 with subsection (f), the city shall pay for the costs incurred by 1-24 the state comptroller to conduct the audit. 1-25 (5) Renumber existing SECTION 2 to be SECTION 3. 1-26 A BILL TO BE ENTITLED 1-27 AN ACT 1-28 relating to the enforcement of the limitation on the amount that 1-29 certain municipalities may retain from amounts collected for 1-30 traffic violations. 1-31 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-32 SECTION 1. Section 144, Uniform Act Regulating Traffic on 1-33 Highways (Article 6701d, Vernon's Texas Civil Statutes), is amended 1-34 by adding Subsections (f) and (g) to read as follows: 1-35 (f) A municipality retaining amounts under Subsection (b) 1-36 shall provide to the state treasurer not later than the 120th day 1-37 after the last day of the municipality's fiscal year: 1-38 (1) a copy of its financial statement prepared for 1-39 that fiscal year and filed as required by Chapter 103, Local 1-40 Government Code; and 1-41 (2) a report that indicates the total amount collected 1-42 for that fiscal year under Subsection (b). 1-43 (g) The treasurer shall enforce the limitation on the amount 1-44 a municipality may retain under Subsection (b). 1-45 SECTION 2. The importance of this legislation and the 1-46 crowded condition of the calendars in both houses create an 1-47 emergency and an imperative public necessity that the 1-48 constitutional rule requiring bills to be read on three several 1-49 days in each house be suspended, and this rule is hereby suspended. 1-50 * * * * *
