A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the change of the name of the San Antonio State Chest
1-3 Hospital to the Texas Center for Infectious Disease.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 11.004(a), Health and Safety Code, is
1-6 amended to read as follows:
1-7 (a) The department is composed of the board, the
1-8 commissioner, an administrative staff, the Texas Center for
1-9 Infectious Disease <San Antonio State Chest Hospital>, the South
1-10 Texas Hospital, and other officers and employees necessary to
1-11 perform efficiently its powers and duties.
1-12 SECTION 2. Sections 13.004(a) and (c), Health and Safety
1-13 Code, are amended to read as follows:
1-14 (a) The Texas Department of Mental Health and Mental
1-15 Retardation may transfer a mentally ill or mentally retarded person
1-16 who is infected with tuberculosis to the Texas Center for
1-17 Infectious Disease <San Antonio State Chest Hospital>.
1-18 (c) The cost of maintaining and treating the person at the
1-19 Texas Center for Infectious Disease <San Antonio State Chest
1-20 Hospital> shall be paid from appropriations to that hospital.
1-21 SECTION 3. Section 13.007, Health and Safety Code, is
1-22 amended to read as follows:
1-23 Sec. 13.007. MEDICAL SERVICES TRUST FUND. The medical
1-24 services trust fund is created as a special account in the general
2-1 revenue fund. Fees and charges collected for physicians' services
2-2 provided at the South Texas Hospital and the Texas Center for
2-3 Infectious Disease <San Antonio State Chest Hospital> shall be
2-4 deposited to the account.
2-5 SECTION 4. Section 13.008, Health and Safety Code, is
2-6 amended to read as follows:
2-7 Sec. 13.008. USE OF MEDICAL SERVICES TRUST FUND. (a) The
2-8 medical services trust fund shall be used for recruiting and
2-9 retaining medical staff at the South Texas Hospital and the Texas
2-10 Center for Infectious Disease <San Antonio State Chest Hospital>
2-11 and supplementing their salaries.
2-12 (b) In addition to other authorized uses, the medical
2-13 services trust fund may be used to supplement salaries of nurses
2-14 and other medical personnel at the South Texas Hospital and the
2-15 Texas Center for Infectious Disease <San Antonio State Chest
2-16 Hospital>.
2-17 SECTION 5. Section 13.033(5), Health and Safety Code, is
2-18 amended to read as follows:
2-19 (5) "State chest hospital" means the Texas Center for
2-20 Infectious Disease <San Antonio State Chest Hospital> and the South
2-21 Texas Hospital.
2-22 SECTION 6. Section 13.071(a), Health and Safety Code, is
2-23 amended to read as follows:
2-24 (a) In addition to treating tuberculosis, the South Texas
2-25 Hospital and the Texas Center for Infectious Disease <San Antonio
2-26 State Chest Hospital> may operate a pilot program to treat persons
2-27 afflicted with other chronic respiratory diseases.
3-1 SECTION 7. Section 13.074(a), Health and Safety Code, is
3-2 amended to read as follows:
3-3 (a) The South Texas Hospital and the Texas Center for
3-4 Infectious Disease <San Antonio State Chest Hospital> may treat not
3-5 more than 25 patients at any one time under the pilot program
3-6 unless the treatment of a greater number of patients does not
3-7 conflict with the primary objectives of the tuberculosis control
3-8 program.
3-9 SECTION 8. Section 553.022(b), Health and Safety Code, is
3-10 amended to read as follows:
3-11 (b) The Texas Department of Mental Health and Mental
3-12 Retardation may enter into agreements with the Texas Department of
3-13 Health for use of the excess facilities of the Texas Center for
3-14 Infectious Disease <San Antonio Chest Hospital> in the operation of
3-15 the school.
3-16 SECTION 9. (a) The name of the San Antonio State Chest
3-17 Hospital is changed to the Texas Center for Infectious Disease.
3-18 (b) A reference in law to the San Antonio State Chest
3-19 Hospital is a reference to the Texas Center for Infectious Disease.
3-20 (c) An appropriation for the use and benefit of the San
3-21 Antonio State Chest Hospital is available for the use and benefit
3-22 of the Texas Center for Infectious Disease.
3-23 (d) Before using new stationery or other supplies printed
3-24 with the hospital's name as changed by this Act, the hospital shall
3-25 use all stationery and other supplies that are printed with the
3-26 hospital's former name and that are in its possession on the
3-27 effective date of this Act.
4-1 SECTION 10. This Act takes effect September 1, 1995.
4-2 SECTION 11. The importance of this legislation and the
4-3 crowded condition of the calendars in both houses create an
4-4 emergency and an imperative public necessity that the
4-5 constitutional rule requiring bills to be read on three several
4-6 days in each house be suspended, and this rule is hereby suspended.
