                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the requirement that the commissioners court of a
    1-3  county approve change orders for county construction contracts.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 262.031(b), Local Government Code, is
    1-6  amended to read as follows:
    1-7        (b)  If a change order involves a decrease or an increase of
    1-8  $25,000 <$15,000> or less, the commissioners court may grant
    1-9  general authority to an employee to approve the change orders.
   1-10  However, the original contract price may not be increased by more
   1-11  than 25 percent.   The original contract price may not be decreased
   1-12  by 18 percent or more without the consent of the contractor.
   1-13        SECTION 2.  This Act takes effect September 1, 1995.
   1-14        SECTION 3.  The importance of this legislation and the
   1-15  crowded condition of the calendars in both houses create an
   1-16  emergency and an imperative public necessity that the
   1-17  constitutional rule requiring bills to be read on three several
   1-18  days in each house be suspended, and this rule is hereby suspended.

   1-20        Amend HB 939 as follows:
   1-21        (1)  On page 1, line 12, add new subsection (c) as follows:
   1-22        "(c)  The local commissioners court may review any change
   1-23  order approved by this section."
