                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the authority of certain employees of the Texas Natural
    1-3  Resource Conservation Commission to issue field citations for
    1-4  certain violations.
    1-5        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-6        SECTION 1.  Subchapter D, Chapter 5, Water Code, is amended
    1-7  by adding Section 5.121 to read as follows:
    1-8        Sec. 5.121.  FIELD CITATIONS.  A field representative
    1-9  authorized by the commission may issue a citation to a person who
   1-10  engages in conduct that is subject to an administrative penalty
   1-11  under:
   1-12              (1)  Section 26.136, Water Code;
   1-13              (2)  Section 27.1015, Water Code;
   1-14              (3)  Section 28.067, Water Code;
   1-15              (4)  Section 32.011, Water Code;
   1-16              (5)  Section 33.009, Water Code;
   1-17              (6)  Section 34.011, Water Code;
   1-18              (7)  Section 341.049, Health and Safety Code;
   1-19              (8)  Section 361.251, Health and Safety Code;
   1-20              (9)  Section 361.252, Health and Safety Code;
   1-21              (10)  Section 366.0924, Health and Safety Code;
   1-22              (11)  Section 372.004, Health and Safety Code;
   1-23              (12)  Section 382.088, Health and Safety Code; or
   1-24              (13)  Section 401.384, Health and Safety Code.
    2-1        SECTION 2.  This Act takes effect September 1, 1995.
    2-2        SECTION 3.  The importance of this legislation and the
    2-3  crowded condition of the calendars in both houses create an
    2-4  emergency and an imperative public necessity that the
    2-5  constitutional rule requiring bills to be read on three several
    2-6  days in each house be suspended, and this rule is hereby suspended.
