                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the authorized activities of a holder of a brewpub
    1-3  license.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 74.01, Alcoholic Beverage Code, is
    1-6  amended by amending Subsection (f) and adding Subsection (g) to
    1-7  read as follows:
    1-8        (f)  A holder of a brewpub license may sell:
    1-9              (1)  ale or malt liquor to any person in this state to
   1-10  whom a holder of a general class B wholesaler's permit may sell ale
   1-11  or malt liquor under Section 20.01; or
   1-12              (2)  beer to any person in this state to whom a holder
   1-13  of a general distributor's license may sell beer under Section
   1-14  64.01(a)(2) <not sell an alcoholic beverage for resale>.
   1-15        (g)  A holder of a brewpub license is subject to the same
   1-16  requirements that apply to a sale made by:
   1-17              (1)  the holder of a general class B wholesaler's
   1-18  permit for the sale of ale or malt liquor under Subsection (f); or
   1-19              (2)  the holder of a general distributor's license for
   1-20  the sale of beer under Subsection (f).
   1-21        SECTION 2.  This Act takes effect September 1, 1995.
   1-22        SECTION 3.  The importance of this legislation and the
   1-23  crowded condition of the calendars in both houses create an
   1-24  emergency and an imperative public necessity that the
    2-1  constitutional rule requiring bills to be read on three several
    2-2  days in each house be suspended, and this rule is hereby suspended.
