No. 984 1-2 (In the Senate - Received from the House April 10, 1995; 1-3 April 11, 1995, read first time and referred to Committee on State 1-4 Affairs; April 28, 1995, reported favorably, as amended, by the 1-5 following vote: Yeas 8, Nays 0; April 28, 1995, sent to printer.) 1-6 COMMITTEE AMENDMENT NO. 1 By: West 1-7 Amend HB 984 by deleting the following: 1-8 in SECTION 1. of the bill, Section 11.11 (a), Alcoholic Beverage 1-9 Code: 1-10 "or $10,000 if the applicant for a permit or holder of a permit has 1-11 a business located within 1,000 feet of the property line of a 1-12 public school," 1-13 and in SECTION 2. of the bill, Section 61.13 (a), Alcoholic 1-14 Beverage Code: 1-15 "or $10,000 if the applicant for a license or holder of a license 1-16 has a business located within 1,000 feet of the property line of a 1-17 public school," 1-18 A BILL TO BE ENTITLED 1-19 AN ACT 1-20 relating to the filing of a conduct surety bond by certain 1-21 alcoholic beverage permit or license holders. 1-22 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-23 SECTION 1. Section 11.11(a), Alcoholic Beverage Code, is 1-24 amended to read as follows: 1-25 (a) Except as provided in Subsection (e) of this section, an 1-26 applicant for a permit or a holder of a permit issued under Chapter 1-27 25, 28, or 32 of this code shall file with the commission a surety 1-28 bond in the amount of $5,000 or $10,000 if the applicant for a 1-29 permit or holder of a permit has a business located within 1,000 1-30 feet of the property line of a public school, conditioned on the 1-31 applicant's or holder's conformance with alcoholic beverage law. 1-32 SECTION 2. Section 61.13(a), Alcoholic Beverage Code, is 1-33 amended to read as follows: 1-34 (a) Except as provided in Subsection (e) of this section, an 1-35 applicant for a license or a holder of a license issued under 1-36 Chapter 69 of this code shall file with the commission a surety 1-37 bond in the amount of $5,000 or $10,000 if the applicant for a 1-38 license or holder of a license has a business located within 1,000 1-39 feet of the property line of a public school, conditioned on the 1-40 applicant's or holder's conformance with alcoholic beverage law. 1-41 SECTION 3. Sections 11.11(g) and 61.13(g), Alcoholic 1-42 Beverage Code, are repealed. 1-43 SECTION 4. This Act takes effect September 1, 1995, and 1-44 applies only to a license or permit issued or renewed on or after 1-45 that date. A license or permit issued or renewed before the 1-46 effective date of this Act is governed by the law in effect at the 1-47 time of the issuance or renewal, and the former law is continued in 1-48 effect for that purpose. 1-49 SECTION 5. The importance of this legislation and the 1-50 crowded condition of the calendars in both houses create an 1-51 emergency and an imperative public necessity that the 1-52 constitutional rule requiring bills to be read on three several 1-53 days in each house be suspended, and this rule is hereby suspended. 1-54 * * * * *
