H.B. No. 994 1-1 AN ACT 1-2 relating to the employment of children in certain activities. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subchapter B, Chapter 51, Labor Code, is amended 1-5 by adding Section 51.015 to read as follows: 1-6 Sec. 51.015. OPERATION OF MOTOR VEHICLE FOR CERTAIN 1-7 COMMERCIAL PURPOSES. (a) An occupation that involves the 1-8 operation of a motor vehicle by a child for a commercial purpose is 1-9 not a hazardous occupation under this chapter if the child: 1-10 (1) has a driver's license under Chapter 173, Acts of 1-11 the 47th Legislature, Regular Session, 1941 (Article 6687b, 1-12 Vernon's Texas Civil Statutes); 1-13 (2) is not required to obtain a commercial driver's 1-14 license under the Texas Commercial Driver's License Act (Article 1-15 6687b-2, Revised Statutes) to perform the duties of the occupation; 1-16 (3) performs the duties of the occupation: 1-17 (A) under the direct supervision of the child's 1-18 parent or an adult having custody of the child; and 1-19 (B) for a business owned or operated by the 1-20 child's parent or guardian; and 1-21 (4) operates a vehicle that has no more than two axles 1-22 and does not exceed a gross vehicle weight rating of 15,000 pounds. 1-23 (b) The commission shall adopt rules consistent with this 1-24 section. 2-1 SECTION 2. The importance of this legislation and the 2-2 crowded condition of the calendars in both houses create an 2-3 emergency and an imperative public necessity that the 2-4 constitutional rule requiring bills to be read on three several 2-5 days in each house be suspended, and this rule is hereby suspended, 2-6 and that this Act take effect and be in force from and after its 2-7 passage, and it is so enacted.
