                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the authority to abolish the position of marshal in a
    1-3  Type B general law city.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Add a new Section 23.029 to the Texas Local
    1-6  Government Code to read as follows:
    1-7        Sec. 23.029.  ABOLITION OF OFFICE OF MARSHAL.  The governing
    1-8  body of a municipality with a population of less than 5,000 by
    1-9  ordinance may abolish the office of marshal and, at the same time
   1-10  in the ordinance, confer the duties of the office on a municipal
   1-11  police officer appointed as the governing body directs.  However,
   1-12  an elected marshal may not be removed from office under this
   1-13  subsection.
   1-14        SECTION 2.  The importance of this legislation and the
   1-15  crowded condition of the calendars in both houses create an
   1-16  emergency and an imperative public necessity that the
   1-17  constitutional rule requiring bills to be read on three several
   1-18  days in each house be suspended, and this rule is hereby suspended.
