                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to persons eligible to hold an auction on behalf of the
    1-3  state, state agencies, and certain state financial institutions.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  An auction held in this state must be conducted
    1-6  by an auctioneer licensed under Chapter 320, Acts of the 64th
    1-7  Legislature, 1975 (Article 8700, Vernon's Texas Civil Statutes),
    1-8  and residing in this state if any property sold at the auction is
    1-9  being sold by:
   1-10              (1)  this state or an agency of this state; or
   1-11              (2)  a state bank, state savings and loan association,
   1-12  or Texas bank holding company, as those terms are defined by
   1-13  Article 2, Chapter I, The Texas Banking Code (Article 342-102,
   1-14  Vernon's Texas Civil Statutes).
   1-15        SECTION 2.  This Act takes effect September 1, 1995.
   1-16        SECTION 3.  The importance of this legislation and the
   1-17  crowded condition of the calendars in both houses create an
   1-18  emergency and an imperative public necessity that the
   1-19  constitutional rule requiring bills to be read on three several
   1-20  days in each house be suspended, and this rule is hereby suspended.
