                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to prohibiting the advertisement for placement of a child
    1-3  for adoption; providing a penalty.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Chapter 25, Penal Code, is amended by adding
    1-6  Section 25.09 to read as follows:
    1-7        Sec. 25.09.  ADVERTISING FOR PLACEMENT OF CHILD.  (a)  A
    1-8  person commits an offense if the person advertises in the public
    1-9  media that the person will place a child for adoption or will
   1-10  provide or obtain a child for adoption.
   1-11        (b)  This section does not apply to a licensed child-placing
   1-12  agency that is identified in the advertisement as a licensed
   1-13  child-placing agency.
   1-14        (c)  An offense under this section is a Class A misdemeanor
   1-15  unless the person has been convicted previously under this section,
   1-16  in which event the offense is a felony of the third degree.
   1-17        (d)  In this section, "child" has the meaning assigned by
   1-18  Section 11.01, Family Code.
   1-19        SECTION 2.  This Act takes effect September 1, 1995.
   1-20        SECTION 3.  The importance of this legislation and the
   1-21  crowded condition of the calendars in both houses create an
   1-22  emergency   and   an   imperative   public   necessity   that   the
   1-23  constitutional rule requiring bills to be read on three several
   1-24  days in each house be suspended, and this rule is hereby suspended.
