                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the exemption of certain pesticides from registration.
    1-3        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-4        SECTION 1.  Section 76.041, Agriculture Code, is amended by
    1-5  amending Subsection (a) and adding Subsection (d) to read as
    1-6  follows:
    1-7        (a)  Except as provided by Subsection (b), <or> (c), or (d)
    1-8  of this section, before a pesticide is distributed in this state or
    1-9  is delivered for transportation or is transported in intrastate
   1-10  commerce or between points within this state through a point
   1-11  outside the state, it must be registered with the department.  The
   1-12  manufacturer or other person whose name appears on the label of the
   1-13  pesticide shall register the pesticide.
   1-14        (d)  Unless otherwise required by department rule,
   1-15  registration is not required for a pesticide that is exempt from
   1-16  registration with the United States Environmental Protection Agency
   1-17  under federal law.
   1-18        SECTION 2.  The importance of this legislation and the
   1-19  crowded condition of the calendars in both houses create an
   1-20  emergency and an imperative public necessity that the
   1-21  constitutional rule requiring bills to be read on three several
   1-22  days in each house be suspended, and this rule is hereby suspended,
   1-23  and that this Act take effect and be in force from and after its
   1-24  passage, and it is so enacted.
