No. 1114 74R2787 DRH-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to permitting an independent school district to elect 1-3 members to its board of trustees by cumulative or limited voting. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter A, Chapter 23, Education Code, is 1-6 amended by adding Section 23.026 to read as follows: 1-7 Sec. 23.026. ELECTING TRUSTEES THROUGH CUMULATIVE OR LIMITED 1-8 VOTING. (a) An independent school district that elects more than 1-9 one trustee at large in an election may conduct the election using 1-10 a cumulative or limited voting procedure approved by the secretary 1-11 of state. 1-12 (b) The secretary of state shall adopt rules to administer a 1-13 cumulative or limited voting procedure authorized by this section. 1-14 (c) Except for the rules adopted under Subsection (b), the 1-15 election is held in the same manner that a district generally uses 1-16 in electing trustees to its board. 1-17 SECTION 2. This Act takes effect September 1, 1995. 1-18 SECTION 3. The importance of this legislation and the 1-19 crowded condition of the calendars in both houses create an 1-20 emergency and an imperative public necessity that the 1-21 constitutional rule requiring bills to be read on three several 1-22 days in each house be suspended, and this rule is hereby suspended.
