                                 A BILL TO BE ENTITLED
    1-1                                AN ACT
    1-2  relating to the funding of the Texas Real Estate Research Center
    1-3  from certain real estate broker and salesman fees.
    1-4        BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    1-5        SECTION 1.  Section 5(m), The Real Estate License Act
    1-6  (Article 6573a, Vernon's Texas Civil Statutes), is amended to read
    1-7  as follows:
    1-8        (m)  The <Fifteen dollars received by the> commission shall
    1-9  charge and collect as a condition for issuance and for <a> renewal
   1-10  of a real estate broker license the fee under Section 11(a)(14) of
   1-11  this Act.  The commission shall charge and collect as a condition
   1-12  for issuance and <before the expiration of the license or before
   1-13  the first anniversary of the date the license expired and $7.50
   1-14  received by the commission> for <a> renewal of a real estate
   1-15  salesman license the fee under Section 11(a)(15) of this Act.  The
   1-16  commission <before the expiration of the license or before the
   1-17  first anniversary of the date the license expired> shall transmit
   1-18  the fees under this subsection quarterly <be transmitted annually>
   1-19  to Texas A&M University for deposit in a separate banking account.
   1-20  The money in the separate account shall be expended for the support
   1-21  and maintenance of the Texas Real Estate Research Center and for
   1-22  carrying out the purposes, objectives, and duties of the center.
   1-23  However, all money expended from the separate account shall be as
   1-24  determined by legislative appropriation.
    2-1        SECTION 2.  Section 11(a), The Real Estate License Act
    2-2  (Article 6573a, Vernon's Texas Civil Statutes), is amended to read
    2-3  as follows:
    2-4        (a)  The commission shall charge and collect the following
    2-5  fees:
    2-6              (1)  a fee not to exceed $100 for the filing of an
    2-7  original application for a real estate broker license;
    2-8              (2)  a fee not to exceed $100 for annual renewal of a
    2-9  real estate broker license;
   2-10              (3)  a fee not to exceed $50 for the filing of an
   2-11  original application for a real estate salesman license;
   2-12              (4)  a fee not to exceed $50 for annual renewal of a
   2-13  real estate salesman license;
   2-14              (5)  a fee not to exceed $25 for an application for a
   2-15  license examination;
   2-16              (6)  a fee not to exceed $20 for filing a request for a
   2-17  license for each additional office or place of business;
   2-18              (7)  a fee not to exceed $20 for filing a request for a
   2-19  license for a change of place of business, change of name, return
   2-20  to active status, or change of sponsoring broker;
   2-21              (8)  a fee not to exceed $20 for filing a request to
   2-22  replace a license lost or destroyed;
   2-23              (9)  a fee not to exceed $400 for filing an application
   2-24  for approval of an education program under Section 7(f) of this
   2-25  Act;
   2-26              (10)  a fee not to exceed $200 a year for operation of
   2-27  an education program under Section 7(f) of this Act;
    3-1              (11)  a fee of $15 for transcript evaluation;
    3-2              (12)  a fee not to exceed $10 for preparing a license
    3-3  history; <and>
    3-4              (13)  a fee not to exceed $50 for the filing of an
    3-5  application for a moral character determination;
    3-6              (14)  an annual fee of $20 from each real estate broker
    3-7  to be transmitted to Texas A&M University for the Texas Real Estate
    3-8  Research Center as provided by Section 5(m) of this Act; and
    3-9              (15)  an annual fee of $17.50 from each real estate
   3-10  salesman to be transmitted to Texas A&M University for the Texas
   3-11  Real Estate Research Center as provided by Section 5(m) of this
   3-12  Act.
   3-13        SECTION 3.  This Act takes effect September 1, 1995, and
   3-14  applies only to a license issued or renewed on or after that date.
   3-15        SECTION 4.  The importance of this legislation and the
   3-16  crowded condition of the calendars in both houses create an
   3-17  emergency and an imperative public necessity that the
   3-18  constitutional rule requiring bills to be read on three several
   3-19  days in each house be suspended, and this rule is hereby suspended.
