A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to credit in the Teacher Retirement System of Texas for
1-3 out-of-state service.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 823.401(a), Government Code, is amended
1-6 to read as follows:
1-7 (a) Except as provided by Subsection (b), an eligible member
1-8 may establish equivalent membership service credit for employment
1-9 with a public school system maintained wholly or partly by another
1-10 state or territory of the United States or by the United States,
1-11 whether inside or outside the boundaries of the United States, for
1-12 children of its citizens. For purposes of this section, a public
1-13 school system maintained wholly or partly by the United States
1-14 includes a school that is not operated by the United States
1-15 government but has a substantial enrollment of children of American
1-16 citizens and receives regular payments because of that enrollment
1-17 from an agency of the United States government.
1-18 SECTION 2. The importance of this legislation and the
1-19 crowded condition of the calendars in both houses create an
1-20 emergency and an imperative public necessity that the
1-21 constitutional rule requiring bills to be read on three several
1-22 days in each house be suspended, and this rule is hereby suspended,
1-23 and that this Act take effect and be in force from and after its
1-24 passage, and it is so enacted.
