A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to access to criminal history record information by the
1-3 banking commissioner.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 411.092(a), Government Code, is amended
1-6 to read as follows:
1-7 (a) The banking commissioner is entitled to obtain from the
1-8 department criminal history record information maintained by the
1-9 department that relates to a person who is:
1-10 (1) an applicant for a license, charter, or other
1-11 authority granted or issued by the banking commissioner under:
1-12 (A) The Texas Banking Code (Article 342-101 et
1-13 seq., Vernon's Texas Civil Statutes), or any successor to that law;
1-14 (B) Article 350, Revised Statutes;
1-15 (C) The Sale of Checks Act (Article 489d,
1-16 Vernon's Texas Civil Statutes);
1-17 (D) Chapter 512, Acts of the 54th Legislature,
1-18 Regular Session, 1955 (Article 548b, Vernon's Texas Civil
1-19 Statutes); or
1-20 (E) Chapter 712, Health and Safety Code; or
1-21 (2) a principal of an applicant under Subdivision (1)
1-22 <for a license under that article>.
1-23 SECTION 2. The importance of this legislation and the
1-24 crowded condition of the calendars in both houses create an
2-1 emergency and an imperative public necessity that the
2-2 constitutional rule requiring bills to be read on three several
2-3 days in each house be suspended, and this rule is hereby suspended,
2-4 and that this Act take effect and be in force from and after its
2-5 passage, and it is so enacted.
